Zusammenfassung

  • Allerlei staatlichen Eingriffe werden mit einem angeblichen «öffentlichen Interesse» gerechtfertigt – so auch die aktuellen Massnahmen zur Pandemiebekämpfung. Dabei gibt es höchst unterschiedliche Interpretationen dieses Begriffs.
  • Die Behauptung eines öffentlichen Interesses impliziert, dass sämtliche Mitglieder einer Gesellschaft die gleichen Ziele verfolgen und dafür die gleichen Mittel bevorzugen. Doch eine Gesellschaft freier und unabhängiger Menschen kann nur als ein komplexes, aber ungeplantes System von aufeinander abgestimmten, aber nicht gemeinsamen Werten definiert werden. Es gibt in einer Gesellschaft keinen gemeinsamen Zweck. Eine Gesellschaft, die individuelle Freiheit und Entscheidungen nicht zulässt und ein gemeinsames Interesse als selbstverständlich voraussetzt, ähnelt einer autoritären Organisation, in der jedes Mitglied Befehlen folgt.
  • In einer demokratischen Gesellschaft eine Politik als «im öffentlichen Interesse» zu bezeichnen, die den Minimalkonsens in Bezug auf die ungeschriebenen «Regeln des gerechten Verhaltens» (F.A. Hayek) der Gesellschaft verletzt, dient vor allem als politisches Machtmittel von Sonderinteressen, um all jene, die durch staatliche Regeln schikaniert werden, dazu zu motivieren, gegen ihren eigenen Willen oder ihre eigenen Interessen zu handeln.
  • Es gibt kein Regelwerk für die Arbeit im öffentlichen Interesse, und weil es lose, mehrdeutig und politisch recht einfach ist, sich hinter dieser verlockenden Phrase zu verstecken, wurde es zu einem integralen Bestandteil des politischen Dialogs, der Vorschriften und des Regierens in modernen Demokratien.

Summary

  • All kinds of state interventions are justified by an alleged "public interest" including the current measures to combat the pandemic. There are many different interpretations of this term.
  • The assertion of a public interest implies that all members of a society pursue the same goals and prefer the same means to achieve them. But a society of free and independent people can only be defined as a complex but unplanned system of coordinated but not shared values. There is no common purpose in a society. A society that does not allow individual freedom and choices and takes a common interest for granted resembles an authoritarian organization in which every member follows orders.
  • In a democratic society, calling a policy "in the public interest" that violates the minimum consensus regarding society's unwritten "rules of just conduct" (F.A. Hayek) serves primarily as a political power tool of special interests to motivate all those victimized by government rules to act against their own will or interests.
  • There is no rulebook for working in the public interest, and because it is loose, ambiguous, and politically quite easy to hide behind this enticing phrase, it has become an integral part of political dialogue, regulations, and governance in modern democracies.
