Es una realidad que el repartidor esta muy expuesto a hurtos, o accidentes de transito, en este caso vamos por lo segundo aunque en un proximo post puedo hablarles sobre los derechos a los cuales podemos acceder en caso de un robo.

Todo lo que voy a explicar con respecto al seguro por enfermedad para el caso especifico de los repartidores que contamos con empresas unipersonales esta amparado bajo lo descrito por el BPS en su pagina oficial y es indispensable pagar las cotizaciones del BPS de manera mensual para acceder a dicho beneficio.
El BPS ampara bajo licencia por enfermedad, pero para acceder a ello, un medico debe certificar que necesitas un reposo, dicho documento de reposo debe ser ingresado en la buzonera del bps, este seguro por enfermedad se va a calcular haciendo un promedio de lo generado en los ultimos 6 meses al último día del mes anterior al de la enfermedad o accidente, dicho promedio (que se calcula sumando los seis meses y diviendo entre 6) se le sacara un 70% y ese monto sera el que recibira el titular de la empresa unipersonal.
Para recibir dicho pago debe registrar alguna cuenta que este afiliada a pagos de BPS, en mi caso use la prex, que se afilia desde la propia app de prex > afiliaciones > bps.
SOLO EL TITULAR DE LA EMPRESA UNIPERSONAL PUEDE ACCEDER A ESTO, SI LA CUENTA NO ESTA A SU NOMBRE Y NO COTIZA EN EL BPS NO PODRA ACCEDER A DICHO PAGO.

Cada primera semana de cada mes, la empresa de pedidos ya, cobra un monto de 253 pesos uruguayos referentes a un seguro, muchos suelen pensar que ese seguro no sirve para nada, y aunque no tengo un portal que respalde lo que voy a explicar voy a hablarles desde mi experiencia personal con dicho seguro.
Al momento del accidente yo llame a los supervisores de logistica (Javier y Acosta), ellos estuvieron conmigo pero en el caso que esto no te suceda igualmente puedes notificarles que tuviste un accidente luego por sus whatsapp, tambien realice un ticket en la seccion de soporte > tuve un accidente > accidente mayor notificando hora, fecha y gravedad del accidente, de igual manera solicitando informacion del seguro.
Desde el mail de [email protected] me escriben notificando que: "El accidente quedó registrado y podrás continuar brindando servicios ni bien te den el alta, se van a contactar contigo la aseguradora vía correo electrónico."
tal como expresa en el correo que dejo mas abajo, la aseguradora es mercer mash beneficios y dicho seguro solo puede ser cobrado por el titular de la cuenta de pedidos ya (el asegurado) y lo que cubre dicho seguro es lo siguiente:
Ø Ejemplos de gastos de rehabilitación cubiertos:
o Gastos de tickets de la sociedad médica o atención particular, que correspondan específicamente a tratamientos de rehabilitación, incluyendo fisioterapia en todas sus formas (láser, ultrasonido, hidroterapia, termoterapia, rutinas de ejercicios personalizados al paciente, etc.)
o Accesorios o aditamentos para la marcha, como por ejemplo bastones, andadores, muletas, sillas de rueda, etc.
o Fajas, rodilleras, coderas, muñequeras, férulas.
o Productos para prevenir escaras: colchones neumáticos, aros de polifón o látex.
o Gastos por concepto de traslado, hasta un máximo del 20% del capital de rehabilitación.
TODOS ESTOS GASTOS SON CUBIERTOS EN MODO DE REEMBOLSO, POR LO CUAL SE DEBEN ENVIAR LAS FACTURAS Y LOS DOCUMENTOS SOLICITADOS PARA RECIBIR EL DINERO DEL REEMBOLSO DE LOS GASTOS YA HECHOS.

Al consultar con un supervisor, me indica que en caso de incapacidad permanente o muerte (cobra la familia), existe una compensación, no estoy segura de ello porque no fue mi caso, pero de ser el caso de enfrentarse a ello, recomiendo consultar por ticket o a la aseguradora los requisitos para acceder a dicha compensación.

Este es el beneficio que mas me ayudo luego del accidente tratare de explicarles desde mi experiencia personal y desde lo estipulado en la ley, de igual manera les dejo una guia completa llamada "Guía de orientación y recursos para ciudadanos afectados por siniestros de tránsito", recurso que me ayudo mucho y esta redactado por entes publicos de la ley y salud en Uruguay.
El S.O.A. es el seguro obligatorio de automotores, dicho seguro cubre el fallecimiento o lesiones ocurridas durante un siniestro de transito con vehiculos aoutomotores, en el caso de una lesion se tiene hasta dos años para reclamar dicho seguro y la documentacion minima necesaria para dicho reclamo seria la cedula de identidad vigente, El título Certificado SOA vigente, parte policial del siniestro de transito, certificado emitido por el médico de la ambulancia y del centro de salud que describa la lesion producto del accidente de transito.
¿Quien tiene derecho a reclamar dicho seguro?
La persona afectada en el siniesto con lesiones o la familia directa en caso de que el afectado haya fallecido en el accidente de transito o por producto de ello.
¿Donde se realiza dicho tramite?
No es obligatorio contar con abogado para reclamar este seguro y se puede iniciar el tramite en linea u obtener orientacion en la pagina del Sitio oficial de la República Oriental del Uruguay o de manera presencial en Sector División Secretaria Administrativa ubicada en Liniers 1280, Planta Baja, de lunes a viernes de 09:00 a 17:00 horas. Teléfono: 150 - 7505 o 7504. Sin embargo ir a esa direccion tendra como resultado una orientacion para hacer el tramite online, no el inicio del mismo de manera inmediata.
El monto que precibas por dicho seguro va a depender del estudio que realice la aseguradora de cada caso especifico, pero aspectos como gravedad de la lesión, incapacidad, dificultad para la recuperación, edad, condición medica previa son tomados en cuenta para determinar dicho monto.
En mi experiencia personal al momento del accidente me llamaron muchos abogados que incluso me visitaron estando en el hospital (presiento que las enfermeras o personas de las ambulancias les avisan) y yo le firme un poder, con ese documento ella se encargo recaudar todos los documentos y de iniciar el tramite, su pago fue el equivalente al 20% de mi ganancia y finalmente percibi cerca de 120.000 pesos uruguayos por mi lesion de fractura de femur y mi unica participación fue ir a cobrar el dinero, mediante un cheque del banco itau, que recibi en la oficina de FAR Compañía de Seguros S.A. ubicada en av. burgues 3170 en compañia de la abogada que gestiono mi caso.

Algunos aspectos en consideración del SOA son:
o El seguro SOA que responde por tu lesion es el de la otra persona involucrada en el accidente.
o Si la otra persona se da la a la fuga o no tiene el seguro el estado se encargada de darle tu caso a un grupo de aseguradoras que se encarga de la gestion.
o Si te encuentras en un siniestro donde la otra persona esta lesionada y tu no pagas el SOA puedes enfentar problemas legales como una demanda civil y/o penal.
o Asi seas el responsable del choque igual te corresponde este seguro.
o No importa si el SOA no esta a tu nombre mientras el vehiculo cuente con el seguro vigente.

En conclusión es importante recordar que sobretodo en moto uno esta demasiado expuesto a los elementos del entorno, a la imprudencia propia, al mal menejar de otros vehiculos y al cansancio, es por eso que no solo hay que tomar medidas preventivas del vehiculo, si no tambien tener todos los documentos en regla por si sucede lo peor, ya que aunque la salud es lo mas importante, estar momentanea o permanentemente incapacitado representa sobre todo para los motorizados (trabajadores de delivery) un cese economico, por ende un gran estres y contar con una compensacion o subsidio durante esos momentos genera una tranquilidad que no tiene precio.
