Un poco de charla antes de entrar en el tema que hoy nos compete; A veces me incomoda tener que aclarar esto, pero no está de más recordarlo, muchos de los tips que doy y daré en estas publicaciones no son verdades absolutas, muchos de los errores de los que hablo aún los cometo y los cometía hasta hace no mucho, si bien llevo escasos 4 años en la plataforma, llevo más de diez años en foros, creando contenido, trabajando con creadores de contenido, escribiendo mi propio blog, trabajando como redactor en revistas digitales y como moderador de comunidades, esto no quiere decir que no me equivoque.

Estos post no tienen la finalidad de generar polémica o de decirle a alguien que está haciendo las cosas mal, como siempre digo, quienes me conocen saben que no tengo problema en hacerle mención a cualquier usuario o decir las cosas claras y sin eufemismos, la finalidad de este post es que todos mejoremos la calidad del contenido que creamos, basándonos en las ganas de agregarle calidad a nuestro trabajo.

These posts are not intended to generate controversy or to tell someone who is doing things wrong, as I always say, those who know me know that I have no problem to mention any user or say things clearly and without euphemisms, the purpose of this post is that we all improve the quality of the content we create, based on the desire to add quality to our work.

¿Todo lo que está en internet es público?, muchos creen que si, y no, entienden la complejidad de los derechos de autor, y las implicaciones que conlleva una sanción por abuso de propiedad intelectual. Te voy a dar un ejemplo, supongamos que subes una foto tuya o de un familiar a internet, yo la tomo y la uso como modelo de algo, puede que no te moleste en primera instancia, puede que solo pidas que te paguen algo por usar tu imagen y dependiendo del uso que le den a tu fotografía pedirás que sea eliminada, pero a final de cuentas está en internet ¿Es de dominio público no?

Los derechos de autor no solo protegen a los artistas y creadores de contenido, también protegen a todos los usuarios de internet de que lo que publicamos pueda o no ser utilizado por otros, que recibamos una recompensa o reconocimiento por ello. Tener en cuenta como funcionan los derechos de autor, es como tener en cuenta tus deberes y derechos en el país que resides, y en resumen podría decirse que aunque consumas internet no eres un ciudadano de internet si no conoces y respetas las normas que lo rigen, y antes que algún ignorante me hable de 'Libertad' el significado de esa palabra implica ser responsables de nuestros actos y sus consecuencias.

Everything on the internet is public?, a lot of people think it is, and they don't, they understand the complexity of copyright, and the implications of a sanction for intellectual property abuse. Copyright not only protects artists and content creators, it also protects all internet users that what we publish may or may not be used by others, that we receive a reward or recognition for it. Keep in mind how copyright works, is like keeping in mind your duties and rights in the country you live in, and in short it could be said that even if you consume internet you are not an internet citizen if you do not know and respect the rules that govern it, and before some ignorant person talks to me about 'Freedom' the meaning of that word implies being responsible for our actions and their consequences.

Para iniciar quiero aclarar un punto basándome en investigación judicial y mis años de trabajo en internet; Si bien lo que la gran mayoría de usuarios realizamos en #Hive como plataforma podría considerarse un blog o vlog de uso personal, informativo o editorial, trabajamos sobre una línea gris bastante delgada y que puede ser vulnerada con una simple palabra.

El Uso comercial se refiere a toda aquella actividad cuya finalidad sea obtener una ganancia económica, sin embargo, cuando hablo de una delgada línea entre los grises de la ley es porque si hacemos un post para ganar seguidores, me gusta o simplemente mostrarnos, no se considera una ganancia económica y en el caso de #Hive mientras no digas a nadie que te vote o te dé una recompensa por tu post, puedes decir que aunque percibes ganancias económicas a través de los votos, no estás obligando a nadie y por ende no es uso comercial.

First of all I want to clarify a point based on judicial research and my years of work on the internet; Although what the vast majority of users do on #Hive as a platform could be considered a blog or vlog for personal, informative or editorial use, we work on a very thin gray line that can be violated with a simple word.

The Commercial use refers to any activity whose purpose is to obtain an economic gain, however, when I speak of a thin line between the grays of the law is because if we make a post to gain followers, likes or simply show us, it is not considered an economic gain and in the case of #Hive as long as you do not tell anyone to vote you or give you a reward for your post, you can say that although you perceive economic gain through votes, you are not forcing anyone and therefore it is not commercial use.

Cansado estoy de ver post de concursos donde uno de los requisitos para participar era votar el post, y dentro de aquel post una imagen de algún banco de imágenes simplemente citando la página de la cual se obtuvo, al revisar la página encontrarme conque esta imagen no cuenta con licencia de uso comercial, pero como nadie dice nada e internet es muy grande nada pasa, hasta que pasa.

Si vamos a seguir utilizando imágenes 'Gratuitas' debemos entender como usarlas, y darles un buen uso, si no posees una licencia comercial para usar dicha imagen, y no quieres pagar lo que cuesta la licencia, busca otra imagen; Puedes hacer como muchos y navegar en la delgada línea, evitando caer en el uso comercial, sin embargo, harto estoy de ver a muchos usuarios quejarse luego cuando les silencian los post y llegan los votos negativos.

En Hive se enseña de forma constante a citar los contenidos utilizados en nuestro post, ya sean citas textuales, imágenes, videos o cualquier otro tipo de contenido que sea usado para complementar el nuestro; Y aunque soy uno de los que constantemente recuerda a la gente que se debe citar, también soy consciente de que no siempre se debe citar y en otras ocasiones esto no es suficiente.

Citar un contenido, mencionando a su autor, el sitio desde el que se obtuvo o atribuyendo créditos, no basta. Imagina que alguien toma tu tarjeta de crédito sin decirte, se compra un almuerzo y presenta tu documento de identidad, te está dando crédito por el uso de tu tarjeta ¿Es suficiente para ti?, es lo mismo que haces al solo hacer mención al autor en algunos casos.

Páginas de imágenes como Pixabay abiertamente aclaran que 'No requieren atribución o mención alguna' sin embargo, muchos ilustrados de la plataforma reportan post, y regañan a otros por no citar contenido de Pixabay, sin embargo, luego tenemos post, donde a mi parecer por redactar rápido, abiertamente se utilizan imágenes de stock, violando más de una de las reglas que protege los derechos de autor y parece que a nadie le preocupa, esto me termina diciendo y con el respeto que merece @hivewatchers que las reglas son para los tontos y son a criterio de quien las aplica. ¿En resumen?, hagamos las cosas bien para no ser el tonto al que se la aplican.

En resumen, yo intento citar constantemente a las webs de donde obtengo las imágenes, aunque primero leo las condiciones de uso, en el caso de artistas de Reddit, Pixabay o Instagram, cuando no puedo contactar con ellos pidiendo permiso, aunque su contenido sea de uso público sin necesidad de atribución, me gusta que otros tengan la oportunidad de conocer a estos artistas o los sitios desde los que yo obtengo las imágenes, videos y música utilizada en mi contenido, la idea no es citar por cumplir una norma, es reconocer el trabajo de otros.

To summarize, I constantly try to cite the websites from where I get the images, although I first read the terms of use, in the case of artists from Reddit, Pixabay or Instagram, when I can't contact them asking for permission, even if their content is for public use without attribution, I like that others have the opportunity to know these artists or the sites from which I get the images, videos and music used in my content, the idea is not to cite for fulfilling a rule, it's to recognize the work of others.

Ya sabemos las razones por las cuales se debe citar un contenido, qué contenidos se deben citar y cuáles no es necesario, que contenidos aunque se citen no basta con ello y la importancia del respeto a los autores; También deberíamos tener un poco más claro lo que es el uso comercial, el uso editorial o personal, y cuál uso le estamos dando al contenido en la plataforma, aunque la línea es sumamente delgada es importante siempre tenerla en cuenta.

Crear contenido es sumamente sencillo, la dificultad se presenta a la hora de crearlo bien y seguir una serie de parámetros, es entonces donde ya sea que imágenes, que música, cuál fuente tipográfica, que videos, o citas bibliográficas utilicemos, es relevante saber si tenemos el derecho para utilizarlas, que parámetros se debe seguir para su buen empleo y cuando simplemente no se debe utilizar.

No hay problema en hablar de un tema de forma respetuosa y utilizar su contenido si este es público, o su autor lo permite, pero si no tienes derecho sobre este, no debes utilizar el contenido bajo ningún concepto, no importa si eres fan de Disney y quieres hablar de la Sirenita, ni si eres fan de Mario Bross y quieres hablar sobre su juego, crear un video con música de Disney a ver cuanto te dura, o utiliza sprites de Mario Bross en tu juego como un homenaje a ver cuanta gracia le hace a Nintendo.

Aclaremos algo, si tu contenido es una crítica, parodia o que pueda no gustarle al autor de una obra, incluso el utilizar el nombre de la obra puede estar violando los derechos de la misma, para ejemplificar, en #Hive todos utilizamos su logo para distintas cosas, incluso como el logo de muchas comunidades y para fines publicitarios, si bien nadie se queja, el día que las personas con los derechos sobre el logo prohíban el uso del mismo, estarán en todo su derecho. Si está en internet no quiere decir que sea público, y un ejemplo más claro no es lo mismo que yo use tu fotografía para ejemplificar a una bonita persona, a que yo emplee tu fotografía en mi post 'Personas deplorables que no merecen respeto'.

Al usar un contenido y la vara que debe utilizarse para medir cuando utilizarlo, es tratarlo como si el contenido fuese nuestro, ¿Qué uso nos gustaría darle? ¿Queremos que otros lucren con él? ¿Nos gustaría que otros nos reconociesen por esto? ¿Es para uso personal o de cualquiera con acceso?, preguntas como estas te harán cuestionarte y determinar bajo tus propios criterios, basado en tu libertad, la forma y el momento para utilizar cada contenido.

Dicho todo esto, la idea y me repito, no es cambiar la forma en la que los usuarios utilizan la plataforma, digamos que la finalidad es mostrar que hay muchos factores que determinan lo que es darle un buen uso a la plataforma, no es lo mismo crear un post que cualquiera con acceso a internet podría, que crear un buen post pensando en todo lo que esto implica.

Nuevamente y haciendo uso de mis derechos por 'Uso editorial' no me interesan los votos, como me dijeron hace un tiempo, veo diferente la plataforma porque no me da de comer, sin embargo, si me gustaría pedirles hacer uso de la herramienta Reblog para que este y los futuros post de esta colección lleguen a la mayor cantidad de usuarios posibles, permitiendo así que más personas puedan ver de forma diferente la plataforma.

Si bien tengo más de cuatro años en la plataforma, mis conocimientos sobre derechos de autor se basan en lo estudiado como diseñador, en lo aprendido a través de mis amigos músicos, pintores y actores, en lo aprendido en mis años como redactor, en mis charlas infinitas con abogados y jueces que se convirtieron en una actividad que disfruto, y en horas de lectura de los términos y condiciones, de cientos de miles de páginas, esos términos y condiciones a los que la mayoría salta pulsando en continuar.
