Should Surrogate Mothers Have Parental Rights?

in Hive Learners18 hours ago

Hello to all hive users 🤗❤️🙏
Hope you all are healthy and doing great in your life🙂

If a woman's body is unable to conceive or has certain deficiencies, she may opt for surrogacy. Today, surrogacy has become very popular, and many childless couples have experienced the joy of parenthood through it. In simple terms, surrogacy involves another woman carrying a pregnancy for a couple who cannot conceive. Once the baby is delivered, it is given to the couple. It's not only women who cannot conceive who use surrogacy; some women choose it because they don't want to experience pregnancy, perhaps because they are in a career field that requires them to maintain their physique, such as acting or another similar profession. With the advancements in medical science today, this technique is becoming easier. Now, let's talk about the surrogate mother who carries the pregnancy for another couple. Regarding her rights, she often has to go through many legal procedures. Several contracts are signed, and these contracts often state that the surrogate mother will have no rights to the child in the future. The surrogate mother is only protected as long as she is carrying the child of another couple; once she gives birth, she has no legal rights over the child. This is often stipulated in the contracts. Today, large hospitals also have these types of contracts signed beforehand to avoid future problems. In reality, all the women involved in the surrogacy process work under a contract, which outlines many details. The couple has to cover all the medical expenses of the surrogate mother and also take special care of her diet and nutrition.

Now, generally, the woman who is doing this work, or any such work done in hospitals, charges are levied for all of it, and where you are charging a fee, you have to work with the necessary paperwork. Therefore, in such a situation, the woman does not have any rights over the children in the future. When you come under the purview of a specific contract, you have to fully follow that contract and work according to everything written in it. Now, if a situation arises where you want to say something regarding that child, then in such a situation, the consent of the child's parents is extremely important because, from the child's perspective, their real parents are the ones they have seen since childhood. The biological mother simply gives birth to the child and her role ends there. Everything that happens afterward, such as raising the children, sending them to school, and bearing all their expenses, is done by their parents. And if the parents are giving any special rights to the biological mother, it will be entirely their personal decision because these things are outside the purview of the law.

If a biological mother is forcibly asserting her rights over the children, it can cause problems for the children, especially if their parents don't want them to know how they were conceived. If the biological mother interferes in such a situation, it can have a negative impact on the children's minds, potentially leading to insecurities about their parents in the future, and many other consequences. If the child's legal parents don't want their child to know about the surrogacy and have a contract in place to that effect, the biological mother should fully respect this and understand why they are making this decision. Sometimes, a surrogate mother might be a relative, and in such cases, she can only discuss matters related to the children if the relationship is very close and the parents allow it. Ultimately, it completely depends on the children's parents whether they grant anyone the right to discuss matters concerning the children, and I don't see anything wrong with that.

It all depends on the Parents, if they can allow the surrogate mother to see the child from time to time, it's not a bad thing.

They might not disclose to the child in detail.
