With an ordinance of March 7th 2022, the Federal Ministry of the Interior and Homeland (BMI) Germany has decided that:
Everyone who fled Ukraine after February 24th 2022 can enter Germany without a visa and can stay here legally for up to 90 days. This includes all groups of people regardless of their country of origin and residence status in Ukraine.
The legal basis for the EU Council decision is the EU Directive 2001/55/EC. The regulation is valid until May 23rd 2022 and can be viewed here.
According to this directive, the people fleeing have a temporary right of residence for one year with the possibility of extension by up to two years. Refugees from Ukraine will be able to apply quickly and unbureaucratic to the local municipal foreigners authority for a temporary residence title under Section 24 of the Residence Act without having to apply for asylum or undergo an individual examination. This would probably be issued initially for six months or one year and can be extended for up to three years.There is no obligation to register or reside during the bridging period until access to humanitarian protection under the EU directive.
Whether and to what extent third-country nationals from Ukraine, who had only a temporary stay in Ukraine, will be offered a longer residence perspective in Germany is still open.
Important for all groups of persons: Advise against applying for asylum for the time being! Stick with the directive.
In principle, the granting of subsidiary protection or the determination of a ban on deportation is conceivable as a result of an asylum application.
In the asylum procedure, there is a right to asylum seeker benefits and accommodation, but all assets except for 200 euros are retained for accommodation costs and security. In addition, the decision on the asylum application will probably take a long time.
Furthermore, applying for asylum has other legal disadvantages compared to a residence status under Directive 2001/55/E.
If a residence title of up to six months validity already exists, this title expires as a result of the asylum application. This also applies to previously lawful visa-free residence.
There is an obligation to live in an initial reception centre (EAE) first. Therefore, it may not be possible to live with relatives or friends.
During the time in the initial reception centre, you are subject to an absolute employment ban for the first nine months.
During the asylum procedure, another residence permit can only be granted in very rare cases. The same applies if the asylum application is rejected.
