On Saturday March 10th 2018, many well-known local activists showed up to help Jerry Martin launch a Constitutional challenge against the Canadian government. This fundraiser was held at Karuna Health dispensary and lounge, collecting $8000 toward legal costs!

What's the Constitutional challenge about?

Jerry Martin is a cannabis dispensary owner from Saskatchewan whose store was raided and shut in preparation for Canada's "legalization", promised for later this year. The government is opening dispensaries across the country, making anyone growing or selling outside their regime a criminal. Some cannabis "crimes" are going from short jail terms or fines, to 14 years of prison under the new laws.

The challenge points out that courts have rules Canadians have the right to medical cannabis, in any form. It then points out that the coming laws (and the existing ones) fail to provide an appropriate and legal source of high quality medical cannabis. For example, some patients don't use computers, and some don't even have a mailing address. Those patients (and many others) would be kept out of the legal regime, and made criminals.

That was a fun night! I'm excited for this constitutional challenge! These regulations are bullshit and need protesting. If successful, this ruling in combination with RV Smith 2015 would state that Canadians have the right to cannabis in all forms AND that they have the right to get it from dispensaries.

These rulings, to those who believe in rulings anyhow, add up to give patients big rights in Canada. The coming LP monopoly infringes on those rights. This challenge, as Neil Magnuson said, is mandatory.
