Dopo un paio di giorni di confronti, per nulla interessanti, con alcune associazioni sindacali, mi trovavo proprio questa mattina su un campo da golf a parlare con il mio caddie di come andrebbe rivista la possibilità di una contrattazione collettiva nel nostro paese.
Non è certo un mistero che i sindacati siano molto simili ai circoli del golf: entrambi hanno degli associati e dispongono di buchi, bandiere e bunkers.
Quello che forse molti ignorano è che i Sindacati giuridicamente sono delle associazioni non riconosciute, con una limitata capacità patrimoniale e processuale.
Se infatti l'art. 39 della Costituzione recita che "L'organizzazione sindacale è libera. Ai sindacati non può essere imposto altro obbligo se non la loro registrazione presso uffici locali o centrali, secondo le norme di legge. E` condizione per la registrazione che gli statuti dei sindacati sanciscano un ordinamento interno a base democratica. I sindacati registrati hanno personalità giuridica. Possono, rappresentati unitariamente in proporzione dei loro iscritti, stipulare contratti collettivi di lavoro con efficacia obbligatoria per tutti gli appartenenti alle categorie alle quali il contratto si riferisce".
Tale disposizione prevede un modello di Sindacato pubblico che è restato inattuato: il sindacato avrebbe dovuto registrarsi — sottoponendosi alla possibilità di controlli amministrativi — presso gli uffici locali o centrali secondo le norme di legge; condizione necessaria per tale adempimento è che gli statuti sindacali sancissero un ordinamento interno a base democratica.
Non credo sia necessario aggiungere altro se non che nessun sindacato si è mai sottoposto a registrazione. I Padri Costituenti non se lo sarebbero mai aspettato.
In ogni casso, dopo alcuni minuti di gioco vedo Oliviero (il mio caddie) correre verso di me, che avevo appena imbucato un birdie alla due, visibilmente agitato: non voleva festeggiare il risultato ma sottoporre alla mia attenzione un ottimo articolo di Affaritaliani.it. Per chi non lo sapesse questa è la prima testata giornalistica online nel nostro Paese e l'unica fonte digitale i cui articoli vengono inseriti nelle rassegne stampa di deputati e senatori.

Per chi lo volesse leggere integralmente il riferimento è a questo link e riporta in dettaglio strategie di sviluppo per compagnie aeree (una in particolare) che sicuramente sono meritevoli di attenzione perchè logiche e lungimiranti.
Da queste pagine ho spesso fornito previsioni di come si sarebbe sviluppato il compito aviation nei prossimi anni e potrete trovare negli articoli precedenti a questo tutte le conferme possibili. Un piano simile era stato approntato anche da noi all' Ufficio Internazionale ma non ho dubbi che quello riportato da Affaritaliani.it non sia in alcun modo derivato dal nostro: è semplicemente frutto di persone con l'esperienza e la vision corrette.
Quando si ha la forza di prevedere strategie per il settore point to point tra i piccoli aeroporti con velivoli STOL, l'implementazione di servizi di drone taxi e addirittura uno sviluppo per il Continente Africano, non si fa altro che rendere più personale ed aperta a tutti l'Aviazione con la A maiuscola, quella che realmente rende libere le persone di viaggiare in comodità e soprattutto sicurezza.
Mi resta il dubbio che anche questo piano, probabilmente concepito su un campo da golf chiacchierando con un caddie, resti inattuato per interessi politici verso altre soluzioni ma l'apertura riportata da parte di alcuni sindacati può far ben sperare.
Ribadisco in conclusione ciò che ho già affermato: non è possibile che il piano sia stato derivato dal nostro (che ad esempio non prevedeva molti voli in Africa) semplicemente perchè è evidente che l'unico modo per continuare ad operare in questo settore sia quello che giustamente è stato proposto anche dagli attori riportati nell'articolo di cui sopra e che da parte mia (e nostra come azienda) non c'è più alcun interesse nei servizi aerei generalisti ma solo in quelli personal.
Vedremo se i sindacati non faranno andare tutto out of bounds come al solito.
After a couple of days of discussions, not at all interesting, with some trade unions, I was this morning on a golf course talking to my caddy about how the bargaining in Italy should be reviewed.
It's no mystery that unions are very similar to golf clubs: they both have members, holes, flags and bunkers.
What perhaps many ignore is that unions are legally unrecognized associations, with limited patrimonial and procedural capacity.
Art. 39 of the Italian Constitution states that "The trade union organization is free. The trade unions cannot be subject to any other obligation than their registration at local or central offices, according to the law. It is a condition for registration that the statutes of the trade unions sanction an internal organization on a democratic basis . Registered unions can, jointly represented in proportion to their members, stipulate collective labor agreements with mandatory effect for all those belonging to the categories to which the contract refers "
This provision provides for a public union model that has not been implemented: the union should have registered - undergoing itself to the possibility of administrative checks - at local or central offices in accordance with the law; a necessary condition for this fulfillment is that the trade union statutes sanctioned an internal order on a democratic basis.
I don't think it's necessary to add anything other than that no union has ever been registered. The Constituent Fathers would never have expected this.
Anyway, after a few minutes of play I see Oliviero (my caddie) running towards me, who had just holed a birdie at the number two, visibly agitated: he didn't want to celebrate the result but to submit to my attention an excellent article by Affaritaliani.it. For the uninitiated, this is the first online newspaper in our country and the only digital source whose articles are included in the press reviews of Italian deputies and senators.

For those wishing to read it in its entirety, the reference is to this link and reports in detail development strategies for airlines (one in particular) that are certainly worthy of attention because they are quite logical.
From these pages I have often provided forecasts of how the aviation business would develop in the coming years (and You can find all the possible confirmations in the articles preceding this one). A similar plan was also prepared by us at the International Office but I have no doubt that the one reported by Affaritaliani.it is in no way derived from ours: it is simply the result of people with the correct experience and vision.
When you have the strength to foresee strategies for the point to point legs between small airports with STOL aircraft, the implementation of drone taxi and even a development for the African continent, it makes Aviation a more personal and open thing, that really frees people to travel in comfort and total safety.
I still have the doubt that even this plan, probably conceived on a golf course while chatting with a caddy, remains unrealized. Political interests focused on other solutions will destroy it but the acceptance reported by some unions can give us hope.
In conclusion, I repeat what I have already said: it is not possible that the plan was derived from ours (which for example did not include many flights to Africa) simply because it is clear that the only way to continue the operation in this sector was the one proposed by the actors listed in the article above and that on my part (and ours, as a company) there is no longer any interest in generalist air services but only in personal ones.
Let's see if the unions don't get everything out of bounds as usual.
