NFT License A

Hello Hive people!

Today I'm using the HIVE blockchain to post an NFT license aimed at giving rights to my art collectors.

Without further ado, here it is:

NFT LICENSE - DOODLEDANGA COLLECTIBLES (LICENSE A)
Background; Instructions for Use.
This NFT License (this "License") is designed to support applications using blockchain technologies and clarify the rights of NFT collectors/holders in relation to the Doodledanga artwork; a collection of digital art created by the artist known as Doodledanga (@doodledanga on Twitter) (@doodle.danga on HIVE Blockchain)(the "Creator").

This License aims to empower Doodledanga NFT collectors by allowing them to create derivative artwork and commercialize these derivatives with the likeness of the NFT without limitation, as long as the NFT collector possesses the specific NFT in their collection (holds the NFT collectible in their blockchain wallet).

THE NFT COLLECTOR/HOLDER IS REQUIRED TO INFORM THE CREATOR WHEN CREATING DERIVATIVE WORKS USING THE NFT. This can be done through any of their accounts.

Definitions.

a. "Artwork/Art" refers to art, design, drawings, paintings, video, animation, audio, text, or other creation associated with a token created (minted) in the Doodledanga collection.

b. "NFT" refers to a non-fungible token conforming the various standards (ERC 721, ERC 1155 or other standards) that represent ownership of a creation from Doodledanga on any blockchain where it is minted (token creation on blockchain).

c. "Own" means the possession of an NFT acquired from a legitimate source (NFT marketplaces or other) and recorded on the relevant blockchain. It refers to the collector’s/holder’s “ownership” of the token(s) and their respective artwork

d. ”Collector” refers to anyone in possession of the NFT. Anyone referring to this license shall be in possession of legitimate Doodledanga NFT on a blockchain network.

e. The Creator holds all legal rights, title, and interest in the Art and its intellectual property rights. The NFT collector's (licensor) rights to the Art are limited to those described in this License. The Creator reserves all rights in and to the Art not expressly granted to the NFT collector.

License.

a. General Use.
Subject to the terms of this License, the Creator grants the NFT collector a worldwide, non-exclusive, non-transferable, royalty-free license to use, copy, and display the Art for their Purchased NFTs. The permitted uses of the Art include:

i. Personal, non-commercial use by the NFT collector.
ii. Display of the art for their legitimately acquired/purchased NFTs in marketplaces or any other medium that cryptographically verifies the token.
iii. Inclusion, involvement, or participation of the NFTs in third-party websites or applications that cryptographically verify each NFT owner's rights to display the Art and remove visibility upon the owner's departure.

b. Commercial Use.
Subject to the terms of this License, the Creator grants the NFT collector a limited, worldwide, non-exclusive, non-transferable license to use, copy, and display the Art for their Purchased NFTs for the purpose of commercializing their own merchandise that includes, contains, or consists of the Art ("Commercial Use"). Commercial Use is allowed as long as the NFT collector continues to own and possess the NFT which contains the Art – this implies the NFT is in a wallet of their possession . The NFT collector is not required to share profits with the Creator.

c. Derivative Works. The NFT collector may create and commercialize derivative works based on the Art for their Purchased NFTs without explicit consent from the Creator. However, the NFT collector must inform the Creator when creating derivative works using the NFT, as this serves as the means for the Creator to be aware of such derivative work creations. New NFTs can ONLY be minted with derivative work, not with the art itself. No further licensing will be transferable by doing this. This license DOES NOT apply to the collectors of these derivative works, and the collector will actually be infringing these license terms if they try to do so.

d. Additional Terms. The license granted is applicable as long as the NFT collector continues to Own the relevant Purchased NFT. If the NFT collector sells, trades, donates, transfers, or disposes of their Purchased NFT, the license granted in this Section 2 immediately expires for those NFTs without notice, and the NFT collector loses further rights to the Art associated with those NFTs. Failure to comply with the license terms or exceeding the license scope may result in termination of the License and the NFT collector being responsible for reimbursing the Creator's enforcement costs. *The Collector is required to credit Doodledanga in their Derivative Artworks.

Disclaimer. This NFT license is not intended to permit the use of the Art for any purpose deemed by the Creator to be in contravention of law or public policy.

The license granted to the NFT collector is deemed to be revoked by the Creator if the NFT is removed from the NFT collector's wallet for any reason whatsoever. This license will in turn be granted to the new owner of the NFT.

PLEASE NOTE: This license is bound to change at any given moment. The license is experimental, so it might be modified in the future to fit the Creator’s intentions. These changes will not be meant to limit the collectors’ rights over the NFTs and their respective Art, but rather fine tuning the license to prevent abuse and/or enforce proper use, UNLESS it is necessary to prevent the integrity of the art, prevent abuse, or ensure proper use of the Art/NFTs. All changes will be notified through the hive blockchain through the following link https://peakd.com/general/@doodle.danga/nft-license-a and the creator’s discord server: https://discord.gg/BvhxGGBdds.

In simple terms..

Anyone holding an NFT that Doodledanga created, that points to this license (License A), has the right to use the art for commercial purposes, to create commercial products or derivatives, AS LONG AS THEY HOLD THE NFT IN THEIR WALLET. Further licensing is prohibited on these derivatives works created from the respective NFT Art.

Any and all production, distribution and sales must stop if they no longer hold the NFT, whether it is they lose it to a hacker, send it to someone, lose access to their wallet, or anything else - meaning they no longer own it or hold it.

The Art

The art is a handmade mandala, that I made with ink pen and color markers. Do you think I should mint as is, or would it be better to digitalize it? Sometimes I feel that it takes away from the original to digitalize the marks made with hand tools, but I think it's a personal choice. What is your view on this?

I'm working on an animation with it also, so I will post about it soon.
