Harvard's legal team argues that the President’s decisions regarding international student entry are not just measures aimed at protecting the United States but should instead be viewed as a vendetta against the institution itself. Yoo, however, believes that such arguments are unlikely to withstand scrutiny at the Supreme Court. He pointed out that historically, the judiciary refrains from overruling executive or legislative assessments regarding national security.
In essence, Yoo contended that judges traditionally respect the domain of national interests as dictated by the executive branch, and thus Harvard's line of reasoning might very well falter.
