This second conviction was based on false testimony. A witness, Jew Smith, claimed she was present at the murder and identified Derek as the shooter. However, her original police statement contradicted her court testimony; she had told officers she had not seen the crime, only to be coerced or threatened into changing her story. Ballistics evidence further complicated the case, indicating the victim was shot outside the building, contradicting the witness’s account.
Despite overwhelming evidence pointing to Derek's innocence, the jury convicted him again, convicted largely on manipulated testimony and suppressed evidence. Derek learned that crucial witnesses and police reports that could have proven his innocence had been ignored or concealed.
