A New York woman, Elizabeth Russet, has filed a class-action lawsuit against Kellogg’s, alleging that their Frosted Strawberry Whole Grain Pop Tarts deceive consumers because they contain only minimal real strawberries. According to the lawsuit, the fruit filling is mostly composed of apples, pears, sugar, and corn syrup, with dried strawberries being present only in small quantities alongside fruit juice concentrates.
The core complaint hinges on the packaging, which prominently features the word “strawberry” and a bright image of strawberries, giving the impression that the product contains a substantial amount of real strawberries—when in fact, the actual berries might be minimal. Russet argues that this misleads consumers, especially those seeking a healthier or fruit-rich snack.
