This misrepresentation is seen as an illegal attempt to suppress free speech.
Dershowitz also points out the hypocrisy: the indictment accuses Trump of conspiracy against rights, yet the courts—most notably the Supreme Court—are expected to overturn any conviction based on this speech because it is protected under the First Amendment. If that happens, Smith’s actions could be seen as an attempt to deny Trump constitutional rights, which is fundamentally hypocritical.
