With the evidence mounting, the husband took decisive legal action by filing for divorce and serving her with papers. His lawyer advised that if she returned to the state, perhaps temporarily, they might secure a 50/50 custody split, which he was willing to accept. But if she chose to stay and persist with her plans, she would only get limited visitation—holidays and summer, at best.
He also discovered that she had been living in a different state since January under the guise of caring for her mother, a ruse that she used to establish residency and plan her interstate move. Fortunately, he managed to disrupt her plans by filing before she could finalize her relocation, preventing her from taking the children with her.
