The Supreme Court has established that obscenity is not protected by the First Amendment, as it is considered to be outside the realm of constitutionally protected speech. However, the Court has also recognized that the definition of obscenity can be subjective and has established a test, known as the Miller test, to determine whether material is obscene. The Miller test asks whether the material appeals to the prurient interest, depicts or describes sexual conduct in a patently offensive way, and lacks serious literary, artistic, political, or scientific value.
