It can, might or might not be accepted depending on the account having enough RC. Transactions can always be broadcasted, if the node is enabled to receive that broadcast. The node receiving the broadcast does not need to be a witness node.

You can send, but if the transaction is accepted or not, it depends on witnesses validating that it can happen. But if the account does not have enough RC, the transaction will fail too.
