It was always the case because Apple wins if the status quo is kept. If it fails, then the people against it will have more data to build a stronger case in the future. And if it succeeds, we can see a huge wave of lawsuits against Apple.

Absolutely. A lot at stake. The class action lawsuits will be lining up if Epic can manage a win, even in a lower court. If Apple appeals, before they get back into court, they will be hit with a wave of lawsuits.
