How have they been using BTC as cash when the fees have been $10+ recently?

They are using the lightning network. Now I don't know what's the fees there but they are working with Strike CEO to build an open-source app that would help users create their bitcoin wallets and spend them with ease.

Is lightning non-custodial? If not then transactions can be censored. Is the only way to have non-custodial transactions/wallets on bitcoin layer 1?
