There has been a lot of talk lately about which constitutional rights, if any, are granted to non-citizens in the United States. Legal scholars themselves disagree at times as to what protections are afforded, but it is clear that some rights, as determined by the US Supreme Court, do apply to non-citizens. I can think of good reasons why we might want to afford non-citizens constitutional rights. For example, a tourist traveling on a passport/visa from a foreign country enters the US and is then charged with a crime. In this example, I think nearly everyone would like to see that person be afforded the same rights as citizens (e.g. right to an attorney, right to unreasonable search and seizures, etc.). However, when a person has illegally crossed over into our country, I, personally think all US Constitutional Rights should be denied.
For example, we see millions of illegals who have come to our country and threaten our very sovereignty. It's surely only a matter of time until states like California decide to give illegals the right to vote in federal elections. Some local jurisdictions like Chicago already allow illegals to vote in some local jurisdictional elections like School Board elections. We also have thousands upon thousands of immigrants entering our Southern border. Could you imagine if they were all afforded a trial? We'd have to pay hundreds (thousands?) of judges, clerks, support staff, etc., and afford every one of them an attorney (if charged with a felony). The economic toll this could take on the United States could be staggering. I won't even mention the national security implications.
Because of this, I call for the ratification of a US Constitutional Amendment to read as follows:
All constitutional rights and provisions herein, including all amendments shall not apply to any person who has entered the country illegally.
It's short and sweet and provides all the protections for those who are here on work visas or travelling abroad, while denying American rights to those who have decided to skip the line and come to our great national criminally.
Except that Constitutional rights enumerated are natural rights. It doesn't matter whether a person entered illegally or not.
Hence the need for the amendment.
From a perspective of a non-US citizen, I think that ILLEGAL is ILLEGAL, and that no country should allow ILLEGAL migrants from coming in. While the border policy (separation of children) is extremely harsh, it is probable that many illegal migrants know what TRUMP's approach is.
I don't know about what others think, but if I were to be a father, and if I knew there was even a slight chance that I might be separated from my kid, I will hold myself responsible for not trying to trespass US territory and take that risk.
ILLEGAL MIGRANTS seem like a huge problem in the US, and while there are many approaches that could be taken, only time will tell if TRUMP's policies are efficient.
Also, let's not forget that under such public criticisms, I am sure the separated children will be well-taken care of by the authorities, despite the fact that they had to do it in the first place.
