What kind of memes and reposts you can put in Russia.

in #russia5 years ago

Known cases You can not even write insults at someone's Internet address. Enough repost or even Like - and then the court, fine, term.
We understand what articles in Russia are imprisoned for being active in social networks - and what should be done to avoid this.
The bill goes to the hundreds
The human rights organization “Agora” published the annual report “Freedom of the Internet 2017: creeping criminalization”. Human rights activists calculated that in the first half of 2016 under Art. 282 of the Criminal Code (incitement of hatred or hostility, as well as the humiliation of human dignity), 168 sentences were issued, in the first half of 2017 - already 205.
The authors of the bill on the abolition of the deadlines for repost (more on this below) voiced similar statistics: in 2012 the number of convicts under article 282 was 130 people, and in 2017 there were already 461 people. Similar data leads and center "Owl".
Do not repost photos of Milonov, or Repost-recidivist
On March 5, 2014, a member of the Council of Open Russia, Dmitry Semenov , published on his VKontakte page photos of Pavel Gubarev (one of the leaders of unrecognized Novorossia) in the form of Russian national unity and photos of militiamen with a swastika tattoo. For this, Semenov was brought to administrative responsibility and fined 1,000 rubles under Art. 20.3 of the Administrative Code of the Russian Federation - for the demonstration of Nazi paraphernalia or symbolism. For repost, they would give as much (or more - as lucky, forget about the logic).
In 2015, Semenov reposted the demotivator - a caricature of Prime Minister Dmitry Medvedev . He was depicted in a fur hat with the inscription "Death to the Russian reptile". The picture illustrated the interview with the showman Matthew Ganapolsky.
Semenov was convicted under Part 1 of Art. 280 of the Criminal Code for public calls for extremism. The prosecutor asked the court to impose a fine in the amount of 200 thousand rubles, but they appointed 50 thousand less.
In 2016, Semenov made two repost photos of Deputy Vitaly Milonov in a T-shirt with the inscription “Orthodoxy or Death” - the slogan of several active (!) Orthodox organizations in Russia. Militiamen saw, Semenov was brought to responsibility.
In 2012, Milonov stated that he had agreed with the Ministry of Justice on the exclusion of photos from the registry. But she is still there. Kinchev also goes to such a place, and he was not banned.
The slogan on a T-shirt was recognized as extremist - it kindled religious strife. At trial, the activist said that the slogan is negative. But this did not help: for the repost he bore administrative responsibility under Art. 20.29 of the Administrative Code (production and distribution of extremist materials). They fined 2 thousand rubles, a thousand for each repost.
The story does not end there. In March 2017, Semenov was fined another 3 thousand rubles for repost news about the previous punishment for publishing a photo of the deputy. Milonov himself was not brought to justice.
Do not learn how to rally
Lawyer Dmitry Tretyakov from the Primorsky Territory posted a message from the channel of the journalist Arkady Babchenko to the chat of supporters of Alexey Navalny - the open Telegram group “Operation Duck”. In it, Babchenko told how to properly rally, mentioning the barricades and Molotov cocktails. Record and repost were made on June 13, 2017.
Against Tretyakov, for the first time in Russian judicial practice, a case was filed for repost in the messenger. March 14, 2018 (9 months after the repost) came to the lawyer with a search. He was arrested until May 13 under Art. 280 of the Criminal Code. The court order stated that "with him and in his home, obvious traces of the crime were found." The air smelled distinctly of repost.
Valentina Dekhtyarenko, an employee of the human rights movement of Open Russia, said: “the forensic examination decided that with its repost Tretyakov called the chat participants to“ violent and destructive, destructive actions ”, among which are indicated“ protest rallies ”.
Tretyakov argued that the repost was not made by him - he had another nickname and another avatar. But he is still in custody.
The authorities have no questions for Babchenko, the original text has not yet been recognized as extremist.
Do not like visitors? For forced labor
Alexander Edelev from Omsk systematically complained on his page on social networks to more visitors. 40-year-old unemployed claimed that because of them can not get a good job.
On the record paid attention, Edelev attracted by Part 1 of Art. 282 of the Criminal Code (incitement of hatred or hostility, as well as the humiliation of human dignity on grounds of nationality, religion, committed using the Internet). Occupation he had - as many as 200 hours of compulsory work.
In addition, they forced all offensive publications to be removed from the pages. They were placed by Edelev for two years. And I could not find a job.
For the repost of articles The Guardian and BuzzFeed - accusations of gay propaganda
Do you read The Guardian and watch BuzzFeed? Do not repost the materials of these resources. For such, for example, Samara activist Evdokia Romanova was found guilty of gay propaganda.
Romanova was overwhelmed with materials on LGBT rights in the world on VKontakte and Facebook. No trash and pornography: The Guardian article on holding a referendum on legalizing same-sex marriage in Ireland and a BuzzFeed article on holding an exhibition on Russian LGBT teens in St. Petersburg , as well as a number of other similar articles.
On July 26, 2017, she was summoned to the police to testify, and on October 18 she was found guilty under Part 2 of Art. 6.21 of the Code on Administrative Offenses of the Russian Federation - in the “promotion of non-traditional relations among minors using the Internet”. And even though the girl’s page is closed to everyone except her friends, and the only minor in Romanova’s friends is her brother, the activist was condemned anyway.
Romanova, you might say, lucky. For the repost of articles and references (four in 2015 and one in 2016), she was assigned only a fine of 50 thousand rubles for an administrative article.
Serial extremism
May 6, 2016, a resident of Tver, Andrey Bubeyev, was sentenced to 2 years and 3 months in a penal colony for two reposts on his VKontakte page. Bubeev made a repost of the journalist Boris Stomakhin's material with the slogan about the territorial belonging of the Crimea and the image of a tube of toothpaste with the signature on the same topic.
Bubeyev was charged under Part 2 of Art. 280 of the Criminal Code (public calls for extremist activity) and Part 2 of Art. 280.1 of the Criminal Code of the Russian Federation (public calls for the implementation of actions aimed at violating the territorial integrity of the Russian Federation). The prosecutor asked for him 3.5 years in prison.
Before that, in August 2015, Bubeyev was already condemned for such reposts. He received 10 months in a penal colony under art. 282 of the Criminal Code of Russia (incitement of hatred or enmity).
Stomakhin, whose materials repost Bubeev, also convicted. On April 22, 2014, he was given 6.5 years in prison. And on April 20, 2016 threw another treshka. In 2006-2011, Stomakhin served a sentence of 280 and 282 articles of the Criminal Code of the Russian Federation. But not for the repost, but for their own posts on the Internet.
Condemning repost - still repost
The case of teacher Eugenia Chudnovets from Kurgan became, perhaps, the most resonant. She made in the closed group a repost clip, which recorded the fact of violence against a child in the camp to them. Regiment "Red Eagles" in Kataysk . In the text of the repost Chudnovets wrote that condemns this behavior. Five hours later, Chudnovets, on the advice of a friend, deleted the video.
But the teacher was still convicted. And not for article 282, but for Part 2 of Art. 242.1 of the Criminal Code for the distribution of child pornography. Gave six months of imprisonment, then the term was reduced to five.
The journalists intervened, they made the case public, they told the president about him. This helped Chudnovets - after 2.5 months in the colony, she was fully acquitted and recognized the right to rehabilitation. The prosecutor's office , which demanded to put the teacher for five years, asked to cancel the sentence due to the lack of corpus delicti.
Children are sent to the camp so far.
He liked the photo of Edward Norton in 2011.
In 2012, Vitold Vitold Filippov was summoned for questioning by the prosecutor's office of Tatarstan . He came, and he was shown a screenshot of his VKontakte page for 2011. The prosecutors said that with regard to Filippov, "an inspection is being conducted on the fact of the placement of extremist materials, materials inciting ethnic hatred, and materials propagandizing fascism and Nazism."
What did Filippov do? Liknul shot from the film "American History X". The photo showed the actor Edward Norton as Derek Vinyar with a swastika on his chest. But in 2011, if you liked like a photo, it was automatically saved in one of the albums on your page.
The film "American History X" is not banned in Russia. He is anti-fascist, Norton was nominated for an Oscar for the role of Vinyar, and the picture was repeatedly shown on Russian channels.
Initially Filippova wanted to condemn for extremism. But two months later, they replaced the criminal article with an administrative article. 20.3 of the Administrative Code for the promotion of Nazi symbols. Promotional action - clicking the "Like" button. The crime is, there is no motive, but it does not matter.
The first case, in which the Russians were convicted of Like, ended in a fine of 1 thousand rubles. Now you know how much it costs to like a photo of Norton.
Good news: perhaps, they will stop planting reposts soon
The bill on the abolition of the deadlines for the repost was submitted to the State Duma on June 26. The document was prepared by deputies Alexey Zhuravlev and Sergey Shargunov . Argumentation: anti-extremist articles of the Criminal Code of the Russian Federation are “overly repressive bias.”
The bill involves amending Art. 282 of the Criminal Code of the Russian Federation "Incitement of hatred or hostility, as well as the humiliation of human dignity." If such actions are committed in public or in social networks, the perpetrator can be given from 2 to 6 years in prison.
The authors of the bill insist that the reposts are “insignificant in the degree of public danger,” and the responsibility for them is unfair. The draft law proposes to punish only if the incitement of hatred or humiliation of dignity is committed with the use of violence or with the threat of its use and / or a person using his official position or by an organized group.
So, social networks and other sites are excluded from the "firing list". Moreover, they want to make the responsibility administrative, and to lighten the punishment: a fine of up to 20 thousand rubles, compulsory work up to 100 hours, or an administrative arrest of up to 15 days.
