Follow up on yesterday’s post. I consulted my attorney today about what is legal to put in my contracts to prevent me from future loses from material costs.
If correctly worded, which I am currently working on. I am due to market volatility able to put in the estimate that the price is only valid for 48 hours. That is the least amount of time allowed legally and only if properly stated, with date and time, initialed by the homeowner at time of presentation.
There is one caveat to this though. If the homeowner requests documentation of the increase, it must be provided by law. Meaning that I now have to get all of my material pricing in writing with a date stamp in order to prove there was an increase in material pricing. It cannot be a word of mouth statement per law.
While this does somewhat protect me, it also adds a crazy amount of time out of my day to get all of this information in writing and filing it with each estimate.
Once a job is signed, there is no legal recourse possible by law to increase a signed binding contract.
Today I’m going to share a hand poured bar from a company that is no longer around. Unfortunately the owner passed away unexpectedly and the business closed. I believe it roughly three years ago now.
They produced some really nice bars in various shapes and sizes. I am a big fan of there work and have quite a few pieces from them.

I don’t know if this is where they got their name from, but there was a Vulture Mine. The Vulture Mine was a gold mine and settlement in Maricopa County, Arizona, United States. The mine began in 1863 and became the most productive gold mine in Arizona history. From 1863 to 1942 A.D., the mine produced 340,000 ounces (9,638.8 kgs) of gold and 260,000 ounces (7,370.9 kgs) of silver. Historically, the mine attracted more than 5,000 people to the area, and is credited with founding the town of Wickenburg, Arizona.The town that served the mine was known as Vulture City.
48 hours, seems like a fair clause to put in. With the price of wood materials slapped with a sudden tariff would likely put you in the red.

I know it sucks, but being honest, I'd love to see that anyway. I think these days people want to know where their money is going, so not having those details on a quote is a bit of a turn off for them. I just got a quote for windows and while they listed the materials, they didn't itemize it at all and it kind of leaves you scratching your head when you see the final total.
