I reckon the charge of trespassing is entirely without merit. I noted in his remarks at one point he specifically asked if he should proceed, and the chairman said he should. Given that exchange was performed in front of numerous witnesses, recorded on video, and should be included in minutes of the meeting, Flaherty can make a strong case for malicious prosecution and seek damages for being illegally sanctioned, for the purposes of censorship at a meeting in which investors have not only a right to address the board and other investors, but a fiduciary responsibility to do so.

He has been shut down and terribly inconvenienced, but I do not believe he has been physically beaten or seriously injured, as many have in similar circumstances, and it may well turn out seeking relief at the bar could dramatically increase the impact of his remarks and on the voting for board members, particularly if he seeks relief for that financial harm he has suffered as a result of his mauling and maligning.
