Abstract
The objective of this study is (1) to explore the logical thinking and argument used by Acehnese Scholars in defending their opinion; (2) to find out any value of maqāṣid al-sharī‘ah contained in shariah implementation of zakah plants related to Acehnese Scholars’ perspective; and (3) the coherent interpretation between maqāṣid al-sharī‘ah and zakah from productive plants. The research procedure focuses on the legal substance of zakat plants as referred in Al-Qur'an and Hadith by analyzing the argumentation related to maqāṣid al-syarī‘ah through istiqra’ maknawi (thematic inference), takhrij al manāt (the realization of the ‘illah in the analogical deduction), and tahqīq al- manāt (the filtration of the possible effective causes so that only one fact is ultimately selected). The argumentation analyzing conducted based on reasoning istiṣlahiah (reasoning based on value) by using logical inductive reasoning. The study found that (1) there is no contrasting logical thinking fronted Mazhabs’ perspective, otherwise the scholars tended to synchronize and fit their perspective to Mazhabs’ arguments as well as contained in Nash; (2) the scholars considered that the implementation of zakah plants did not have any value contained related to maqāṣid al-sharī‘ah. However, the law still has its own maqāṣid values in implementing the zakah; therefor, related to their perspective (3), there is no coherent interpretation between maqāṣid al-sharī‘ah and zakah productive plant.
