JAKARTA - Related to the investment plan of Haj Financial Management Agency (BPKH) in Wakaf Aceh Makkah land, said Senator of Aceh, Fachrul Razi MIP is contrary to Law of Aceh Government (BAL). He referred to Article 16 of the BAL, paragraph 3 states, the affairs of the Government of Aceh which are optional include government affairs that have real potential to improve the welfare of society in accordance with the conditions, uniqueness, and potential Aceh.
In verse 4 it is affirmed that these matters are further stipulated in the Aceh Qanun. "Based on paragraph 4, that Aceh can make Qanun in the management of Baitul Asyi itself based on UUPA as the authority of Aceh in organizing and managing the pilgrimage in accordance with legislation," said Fachrul Razi in a written statement to Serambinews.com in Jakarta Wednesday 14/3/2018). Still said Fachrul Razi, Baitul Asyi's delegation can be managed by the Wali Nanggroe Institution as a mandate of Qanun No 8 of 2012 article 29 points (g) stating: the duties, functions and authorities of the Wali Nanggroe Institution also manage to take care and protect Aceh's treasures inside and outside Aceh; even reinforced in point (h) which allows for cooperation with various parties both domestic and foreign for the progress of Aceh civilization.
In addition, Fachrul also mentioned, BPKH's desire is contrary to Government Regulation No. 3 of 2015 on the authority of the national government in Aceh.
Therefore, the Government can not manage waqaf land because it is not a central authority as regulated in Government Regulation No. 3 of 2015.
This also contradicts Law No. 44 of 1999 concerning the Implementation of Special Feature of Aceh Special Province as Article 2 paragraph (1) which affirms that Aceh is given the authority to develop and manage its privileges.
