Kwak is accused of hitting the victim's back with a beer bottle at a pub in Gaebong-dong, Guro-gu, Seoul in August last year.
The victim asked him to "go out and smoke" when Kwak, who had been in a disturbance due to an argument after drinking alcohol, smoked indoors. Then, Kwak picked up a beer bottle displayed in front of the store and hit the victim on the head as it was. As a result of this incident, the victim suffered eight weeks of cerebral hemorrhage and suffered severe trauma, and dropped out of college.
At the time of the crime, Kwak was on probation for other crimes. In September 2021, he was charged with drunk driving under the Road Traffic Act and was sentenced to one year in prison and two years of probation.
The first trial court sentenced the defendant to two years in prison in January, saying, "The defendant hit a young woman in the head for no reason and suffered considerable damage and heavy responsibility. He was not forgiven (by the victim) and committed the crime during the probation period for other crimes," but added, "We comprehensively considered the deposit for the victim."
Accordingly, Kwak filed an appeal on the grounds that his brother was heavy, and the prosecution filed an appeal on the grounds that his brother was light.
He's a good person except for this case, but it's a probation period for drunk driving.
I don't know if this defense logic is possible.
