Not forbidden, but not so free
Cryptocurrency trading has become an international market phenomenon, especially in countries with consolidated banking systems. However, the unregulated nature of cryptocurrency trading is a huge discussion.
With countries more open to the advent of crypto-economy, others not so much. Consequently, some countries are seeking to implement policies to regulate (even if it is not a consensus of the crypto community) this new economy. In Brazil, regulation is progressing. And for now, it has shown itself to be open and paving the way for the large-scale use of cryptos for the more than 200 million Brazilians.
Licensed Exchanges may operate
Even so, the Brazilian government has been looking closely at the trade involving cryptocurrencies. They recently passed a law that requires every currency exchange to be registered as an economic society.
In other words, these organizations will have to follow strict requirements to operate. This includes having a board of directors, a treasurer and a bank account to receive payments and transfer funds. The government is also requiring cryptocurrency exchanges to take steps to prevent money laundering and terrorist financing.
The main purpose of this law is to protect consumers from fraudulent cryptocurrency trading practices and promote the financial security of the country. The law also gives the federal government more control over the management of the national currency against cryptocurrency speculation.
Regulating little by little
Basically, the government say they wants to prevent people from investing in foreign currencies without affecting the value of the Brazilian real. A secondary objective is to create a suitable industry for cryptocurrencies in Brazil – something that has not yet happened.
While this is a big step towards regulation, cryptocurrency trading is still not fully regulated. Cryptocurrency exchanges are not yet required to follow strict bank account requirements and anti-money laundering laws.
The government will be closely monitoring how companies handle these requirements so they can make the necessary adjustments to ensure a safe business environment. Once this system is in place, it will provide consumers with a better way to protect their assets while trading cryptocurrencies.
There is still backward thinking from many "economists" who believe that cryptocurrencies like bitcoin and ethereum are fraudulent schemes designed to take money from investors. Because of this, many believe that these coins should be avoided as they do not provide any real benefit to society.
Others still believe that cryptocurrencies can be misused by criminals, but they can also be useful for legitimate reasons, such as buying goods and paying bills. That's why many countries are taking a cautious approach to cryptocurrency regulation - they don't want this technology to fall into the wrong hands.
Brazil is a huge niche for the crypto universe
While cryptocurrencies cannot yet be regulated by all countries, Brazil is heading in a good direction. It is already an advance not to be prohibitive. Its recent law also provides consumers with protection from fraudulent business practices and we hope to encourage further business ventures in the cryptocurrency market.
Until a worldwide regulatory framework for cryptocurrencies is in place, governments must enact fair regulations that protect consumers from fraudulent business models and unregulated markets. In Brazil Fintechs, brokers and traditional banks already offer purchase and investment possibilities through their own apps, funds are already operating, and trades receiving crypto grow exponentially.
The law's are still in progress and analysis, PL 3,825/2019, authored by Senator Flávio Arns (Pode-PR) and written by Senator Irajá (PSD-TO), is now awaiting analysis by the Chamber of Deputies. And a lot can still happen in this political uncertainty that the country is experiencing.

O comércio de criptomoedas tornou-se um fenômeno de mercado internacional, principalmente em países com sistemas bancários consolidados. No entanto, a natureza não regulamentada do comércio de criptomoedas é uma enorme discussão. Com países mais abertos ao advento da criptoeconomia, outros nem tanto. Consequentemente, alguns países estão buscando implementar políticas para regulamentar( mesmo que não seja um consenso da comunidade cripto) essa nova economia. No Brasil a regulamentação caminha. E por enquanto tem mostrado-se aberta e abrindo caminho para a utilização em larga escala das criptos para os mais de 200 milhões de brasileiros.
Mesmo assim, o governo brasileiro tem olhado de perto o comercio que envolve as criptomoedas. Recentemente, eles aprovaram uma lei que exige que todo tipo de câmbio seja registrado como uma sociedade econômica. Em outras palavras, essas organizações terão que seguir requisitos rígidos para operar. Isso inclui ter um conselho de administração, um tesoureiro e uma conta bancária para receber pagamentos e transferir fundos. O governo também está exigindo que as exchanges de criptomoedas tomem medidas para prevenir a lavagem de dinheiro e o financiamento do terrorismo.
O principal objetivo desta lei é proteger os consumidores de práticas fraudulentas de negociação de criptomoedas e promover a segurança financeira do país. A lei também dá ao governo federal mais controle sobre a gestão da moeda nacional contra a especulação de criptomoedas. Basicamente, o governo quer impedir que as pessoas invistam em moedas estrangeiras sem afetar o valor do real brasileiro. Um objetivo secundário é criar uma indústria adequada para criptomoedas no Brasil – algo que ainda não aconteceu.
Embora este seja um grande passo em direção à regulamentação, o comércio de criptomoedas ainda não está totalmente regulamentado. As exchanges de criptomoedas ainda não são obrigadas a seguir requisitos rígidos de contas bancárias e leis antilavagem de dinheiro. O governo estará monitorando de perto como as empresas lidam com esses requisitos para que possam fazer os ajustes necessários para garantir um ambiente comercial seguro. Quando esse sistema estiver em vigor, ele fornecerá aos consumidores uma maneira melhor de proteger seus ativos enquanto negociam com criptomoedas.
Ainda há um pensamento retrogrado de muitos "economistas" que acreditam que criptomoedas como bitcoin e ethereum são esquemas fraudulentos projetados para tirar o dinheiro dos investidores. Por causa disso, muitos acreditam que essas moedas devem ser evitadas, pois não fornecem nenhum benefício real para a sociedade. Outros acreditam que as criptomoedas podem ser mal utilizadas por criminosos, mas também podem ser úteis por motivos legítimos, como comprar mercadorias e pagar contas. É por isso que muitos países estão adotando uma abordagem cautelosa em relação à regulamentação de criptomoedas - eles não querem que essa tecnologia caia em mãos erradas.
Embora as criptomoedas ainda não possam ser regulamentadas por todos os países, o Brasil está indo na direção certa. Já é um avanço não ser proibitivo. Sua lei recente fornece aos consumidores proteção contra práticas comerciais fraudulentas e esperamos incentivar empreendimentos comerciais adicionais no mercado de criptomoedas. Até que uma estrutura regulatória mundial para criptomoedas seja implementada, os governos devem promulgar regulamentações justas que protejam os consumidores de modelos de negócios fraudulentos e mercados não regulamentados. Fintechs, corretoras e bancos tradicionais já oferecem possibilidades de compra e investimentos pelos seus próprios aplicativos, fundos já operam, e comércios recebendo em cripto crescem exponencialmente.
Os projetos de lei ainda estão em curso, o PL 3.825/2019, de autoria do senador Flávio Arns (Podemos-PR) e redigido pelo senador Irajá (PSD-TO), agora aguarda análise da Câmara dos Deputados. E ainda muita coisa pode acontecer nessa incerteza politica que o pais vivencia.

The regulation of cryptocurrencies in Brazil has been a hot topic in recent years. The Brazilian government has been working on a regulatory framework for cryptocurrencies since 2019, but the process has been slow due to the complex nature of the topic.
However, progress is being made and the regulation of cryptocurrencies in Brazil is slowly taking shape. The government has already defined what types of activities will be allowed and has created a working group to draft the regulations.
It is still too early to say how the regulation of cryptocurrencies in Brazil will progress, but the government is making progress on this complex and important issue.
That's right! In fact! I agree that it's still early days and that we need more time to assess how regulation will follow around here. But I'm glad that crypto has an opening with the financial elite, which demonstrates that we will follow a path more regulatory than prohibitive.
